CONSUMER ELIGIBILITY CRITERIA
  

Consumers may be eligible for the HCBS MR Waiver if they meet the following criteria:

1. A primary diagnosis of mental retardation as determined by a psychologist or psychiatrist.

2. Full scale IQ of 75 or below.

3. Determined eligible for Medicaid (Title XIX). Consumers may be eligible prior to accessing waiver services or be determined eligible through the application process for the waiver program. Additional opportunities to access Medicaid may be available through the waiver program even if the consumer has previously been determined ineligible.

4. In need of long-term care services that would otherwise be provided by an intermediate care facility for consumers who are mentally retarded.

5. Receive Medicaid case management services when MR Waiver services are begun.

6. An interdisciplinary team composed of the consumer, Medicaid case manager, service provider and whomever the consumer chooses determines the type and amount of service needs.

7. Have an Individual Comprehensive Plan (ICP) developed annually.

8. Adults must utilize, at a minimum, one unit of Supported Community Living, Respite, Supported Employment or CDAC per month. Children must utilize, at a minimum, one unit of Supported Community Living, Respite or CDAC per month.

9. Each county and the State has designated the number of consumers (payment slots) which can be served under the HCBS MR program. A payment slot must be available and assigned to the individual at the time of application or after Disability Determination, whichever is latter. Once assigned, the payment slot shall be held for the applicant for 180 days to arrange services unless the person has been determined ineligible for the program. If the slot has not been used in 180 days, it reverts to the county or State for use by the next applicant.
